Our firm defends insurance agents and brokers who are sued in all
kinds of civil litigation. Having practiced insurance defense for several
decades, we routinely deal with insurance agents and brokers in the
handling of cases in which they are sued for a myriad of alleged
reasons, including coverage issues and cases involving insurance
fraud.
Currently, we are defending an insurance broker who acquired the
business of another broker and is being sued by an insured for alleged
errors and omissions of the acquired broker, which occurred before
the acquisition. We are also defending a claim against an insurance
broker who is being sued by an insured who is claiming that his house
was under-insured when it was destroyed by one of the recent
Southern California wildfires. The basis of the claim is an alleged
failure by the broker to advise him that his house was under-insured.
Our firm also represented a wholesale broker who sued a retail broker
for fraud and breach of contract, obtaining a substantial settlement
after minimal discovery.
Whenever legal research is required, our extensive, in-house library
includes the 4-volume set “Responsibilities of Insurance Agents and
Brokers” authored by Bertram Harnett, in addition to several treatises
on insurance law and practice.
